Form I-765 Document Checklist (Pending Green Card)

MimiDocu prepares Form I-765 only for category (c)(9): applicants with a pending Form I-485. It does not prepare other work permit categories. This checklist covers items those applicants commonly gather.

Who this guide is for

  • People with a pending Form I-485 who want permission to work
  • Applicants filing Form I-765 together with Form I-485

Common documents

  • File together with Form I-485, or, if filing separately, include a copy of your Form I-485 receipt notice or other proof it is pending
  • A copy of a government-issued photo ID, such as your passport identity page
  • Your Form I-94 record, if you have one
  • Two passport-style photos, as the instructions describe
  • A copy of any earlier work permit, front and back

Important considerations

  • Filing Form I-765 does not itself authorize employment. If you do not already have valid work authorization, wait until you have the required authorization and documentation before working.
  • Check the current fee with the USCIS Fee Calculator; some filings with Form I-485 have special fee rules.

When to consider legal help

Consider speaking with a qualified immigration attorney or accredited representative if your situation involves any of the following:

  • Any arrest, criminal charge, or conviction, in any country
  • Past or current removal (deportation) proceedings, or a prior removal order
  • Unlawful presence, a prior visa overstay, or a past immigration violation
  • Questions about whether you need a waiver or qualify for an exception
  • Any past unauthorized employment
  • A Form I-485 filed with the immigration court instead of USCIS
